Who does this policy apply to?

This policy applies to all third parties who use Western Washington University names, trademarks and logos.

Overview

In support of its educational mission, Western Washington University partners with various educational, government, non-profit and commercial organizations to support students and create economic development opportunities for the region. However, third party partners are only permitted to use Western Washington University name or trademarks under the terms of a license agreement or by receiving written authorization from designated university officials. The University vigorously protects its trademarks (including its names, identity, logos and images) from unauthorized use.

Definitions

University Trademark

As defined by the U.S Patent & Trademark Office, a trademark is a word, phrase, symbol or design, or a combination of words, phrases, symbols, mascots, and any other marks associated with the University. These trademarks include both registered and unregistered marks:

Third Party Entity

A legally established entity separate from the University with which the University has a contract or formal relationship. 

Contract

A written or electronic agreement between the University and a non-Western party that creates mutual obligations enforceable by law. A non-Western party may include, but is not limited to, municipal or governmental entities, non-profit or for-profit entities, educational institutions, and individuals.

Licensing

A contractual agreement that allows the use of University trademarks, images, songs, and words for approved applications in exchange for a royalty payment to the University. For the policy addressing the patenting and licensing of research, please refer to POL-U4520.03 Patent and Copyright Policy.

Trademark Licensing Program

The Trademark Licensing Program protects the name and marks of the University, while enhancing the institution's image by ensuring the use of the marks on high-quality merchandise in alignment with the University’s brand standards.

Policy Statements

1. Third Party Use of Name(s) and Trademarks Requires Written Authorization

Vice President for University Relations and Marketing authorizes third-party use of the Western Washington University name(s) and trademarks. The Vice President for University Relations and Marketing may delegate implementation of this policy to the Director of University Marketing and Brand Strategy.

University trademarks may be used by persons or entities outside the University only pursuant to a license, memorandum of understanding, or sponsorship agreement stating the terms and conditions of such use. University Relations and Marketing evaluates all requests to use University brand assets in accordance with this policy and the University’s Brand and Communication Guide.

2. University -Sponsored Organizations May Be Granted Use of University Trademarks, Names or Logos

 As part of a university-wide sponsorship agreement, an organization may be granted permission to use University names or logos with the understanding that use must be consistent with University policy for usage of such assets. Sponsorship itself does not automatically grant the sponsor the right to use University trademark assets.

3. Third-Party Organizations Must Not Use University Name(s) or Assets to Endorse Products or Services

Third-party organizations shall not use the University name nor any University trademark in any way that states or implies endorsement of a commercial product or service, gives a false impression, is misleading, or could result in an inaccurate impression regarding the University’s relationship with any person or organization. A third-party may not represent itself as WWU.

The University’s name(s) or brand assets may not be used to endorse any products or services. All marketing materials must clearly and accurately state the partnership between Western Washington University and the third-party entity.

4. Third-Party Entities and WWU Departments, Programs, and Offices Must Adhere to WWU's Trademark Licensing Program Guidelines

All entities intending to create and distribute promotional items that include the University's trademarks must go through WWU’s Trademark Licensing Program.

Licenses are required for goods meant for sale that feature any WWU logo or mark and all of the words such as Western Washington University, Western, WWU, and Vikings. It also includes items in which there may be a likelihood of confusion regarding the origin of the goods, such as the use of the words "Western" or "Western Washington" in the school colors, or the use of a likeness of a Viking to imply affiliation with the University. If the marks are on products used for giveaways or internal use, it is recommended that departments, offices, or programs use a licensed vendor to produce the item.

5. Permission for the Use of University Trademark May be Withdrawn

The University monitors all uses of its trademarks in compliance with and assured protection of federal, state, and international trademark law. Unauthorized use of the University trademarks is subject to civil and criminal penalties.

If at any time the Vice President of University Relations & Marketing or designee determines that the University trademark has been misused, is misleading or violates this policy, they may withdraw the permission for trademark use.
