PRO-U10.09A Regarding Access to University Property and Student Information for Immigration Enforcement Purposes

Pursuant to WWU policy, if approached by anyone engaging in, or intending to engage in immigration enforcement, including federal immigration authorities, prior to permitting entrance, employees shall:
- Immediately alert and direct the person to the University Police Department and/or Bellingham Assistant Attorney General’s Office;
- Immediately report receipt of any information request relating to immigration enforcement to the University Police Department and/or the Bellingham Assistant Attorney General’s Office, who shall document the request.
The University Police Department in Consultation with the Bellingham Assistant Attorney General’s Office
- Upon notification of immigation enforcement activity, verify and record the person’s credentials (at least, badge number and name), record the names of all persons they intend to contact, collect the nature of their business at the university, request a copy of the court order or judicial warrant authorizing their presence and activity, and log the date and time and forward the request to the Bellingham Assistant Attorney General’s Office for review.
- Review the court order or judicial warrant for signature by a federal judge and validity. For the University to consider it valid, any court order or judicial warrant must state the purpose of the enforcement activity, identify the specific search location, name the specific person or entity to whom access must be granted, include appropriate date ranges, and be signed by a federal judge.
- Bellingham Attorney General's Offfice, will determine whether access shall be allowed to contact or question the identified individual and shall communicate that decision to the University President or their designee.
- If the requestor is seeking access or information regarding a student under 18 years old, the University shall make a reasonable effort, to the extent allowed by FERPA, to notify the parent/guardian of any immigration enforcement concerning their student, includng contact or interview.
- Request a University representative to be present during any interview. Access to information, records, or areas beyond that specified in the court order or judicial warrant shall be denied.
